The Terms must be communicated to the individual customer before the conclusion of the contract and be accessible on a durable medium, in particular from the footer of the website.<\/p>\n\n<h2>1. Scope of Application<\/h2>\n<p>These Terms apply to any order of products placed on the website for individuals in mainland France, unless otherwise stated on the product page or during the order process. They govern the contractual relationship between the seller and the consumer customer in the context of a distance sale.<\/p>\n<p>The customer declares to be an adult natural person acting as a consumer or non-professional. The sale of alcohol to minors under 18 is prohibited; any order placed on the website constitutes an express declaration that the customer is of legal age on the date of the order.<\/p>\n\n<h2>3. Products<\/h2>\n<p>The products offered for sale are those listed on the website at the time of consultation, subject to availability. Each product is described with its essential characteristics, vintage where applicable, volume, price inclusive of all taxes, and, where relevant, any specific storage or consumption conditions.<\/p>\n<p>Photographs, product descriptions, and other presentation elements on the website are provided for illustrative purposes and have no contractual value with respect to minor presentation variations, provided they do not concern an essential characteristic of the product.<\/p>\n\n<h2>4. Availability<\/h2>\n<p>Product offers are valid as long as they remain visible on the website and subject to availability. In the event of unavailability after an order has been confirmed, the seller will inform the customer as soon as possible and will either refund the unavailable product or offer an equivalent solution at no extra cost, subject to the customer&rsquo;s agreement.<\/p>\n\n<h2>5. Price<\/h2>\n<p>Prices are stated in euros, inclusive of all taxes, excluding delivery charges unless otherwise indicated. Before the order is confirmed, the customer is informed of the total price to be paid, including the price of the products, applicable taxes, and any delivery charges.<\/p>\n<p>Faulkner Wine SARL reserves the right to change its prices at any time; however, the price applicable is the one displayed on the website at the time of the order. No clause may allow a unilateral change to a price already accepted by the customer without a legitimate legal basis.<\/p>\n\n<h2>6. Order<\/h2>\n<p>Orders are placed on the website via the online ordering process. The customer selects the desired products, reviews a detailed order summary, can identify and correct any errors, and then confirms the order through an explicit act involving an obligation to pay.<\/p>\n<p>The final confirmation button must display an unambiguous wording such as \u00ab\u00a0order with obligation to pay\u00a0\u00bb or an equivalent formulation. The sale is deemed concluded once the order confirmation has been sent to the customer electronically.<\/p>\n<p>Faulkner Wine SARL reserves the right to refuse or cancel any order in the event of a prior dispute, suspected fraud, an obvious anomaly, an order placed by a minor, or exceptional unavailability. In such cases, any amounts wrongly collected will be refunded to the customer.<\/p>\n\n<h2>7. Payment<\/h2>\n<p>Payment of the price is made in full on the date of the order, using the payment methods offered on the website. Available payment methods, any restrictions, and the steps of the payment process are indicated before the contract is concluded.<\/p>\n<p>The order is only finally recorded once payment has been validated or, where applicable, once the payment institution has authorized the debit. The customer guarantees that they are fully entitled to use the chosen payment method.<\/p>\n\n<h2>8. Delivery<\/h2>\n<p>Products are delivered to the address provided by the customer when ordering, within the delivery area offered on the website. The seller indicates to the customer, before the contract is concluded, the date or timeframe by which it commits to delivering the goods.<\/p>\n<p>Unless otherwise stated, delivery takes place no later than thirty days after the contract is concluded. In the event of a delivery delay, the customer benefits from the rights set out in the French Consumer Code, including the option to require the seller to deliver within a reasonable additional period and, failing that, to terminate the contract under the legal conditions.<\/p>\n<p>The customer must check the condition of the parcel upon receipt and promptly report any visible anomaly or damage to the carrier and to customer service. This check does not affect the customer&rsquo;s legal guarantees.<\/p>\n\n<h2>9. Transfer of Risk<\/h2>\n<p>The risk of loss or damage to the products transfers at the moment the customer, or a third party designated by the customer other than the carrier proposed by the seller, takes physical possession of the products. Where the customer entrusts delivery to a carrier other than the one proposed by the seller, the risk transfers upon handover of the goods to that carrier.<\/p>\n\n<h2>10. Right of Withdrawal<\/h2>\n<p>The consumer customer has fourteen days from receipt of the products to exercise their right of withdrawal, without having to justify their decision or bear any costs other than the direct cost of returning the goods, unless the seller agrees to bear that cost.<\/p>\n<p>To exercise this right, the customer may send the seller any unambiguous statement expressing their wish to withdraw, or use the standard form provided in the appendix. As of June 19, 2026, where a contract is concluded via an online interface, the trader must also offer a feature allowing this right to be exercised directly online, known as the \u00ab\u00a0one-click withdrawal\u00a0\u00bb function.<\/p>\n<p>The customer must return the products within fourteen days of sending their withdrawal decision, in their original condition, complete, and fit for resale. Faulkner Wine SARL will refund all payments received for the returned products, including the initial standard delivery charges where applicable, no later than fourteen days after recovering the goods or receiving proof of shipment, whichever occurs first.<\/p>\n<p>The right of withdrawal does not apply to the exclusions provided for by law, in particular where met for goods clearly personalized or unsealed goods that cannot be returned for reasons of hygiene or health protection. These exclusions are to be interpreted strictly.<\/p>\n\n<h2>11. Legal Guarantees<\/h2>\n<p>Products sold benefit from the legal guarantee of conformity and the legal guarantee against hidden defects under the conditions set out in the French Consumer Code and the Civil Code. The Terms must inform the customer of the existence and terms of these guarantees.<\/p>\n<p>The consumer may take action under the legal guarantee of conformity under the legal conditions applicable to goods. They may also choose to invoke the guarantee against hidden defects under Articles 1641 et seq. of the Civil Code.<\/p>\n<p>Any claim under the legal guarantees must be sent to Faulkner Wine SARL&rsquo;s customer service using the contact details indicated in Article 1. The customer is advised to keep any relevant supporting evidence, in particular the order number, a photograph of the product, and a description of the defect found.<\/p>\n\n<h2>12. Liability<\/h2>\n<p>Faulkner Wine SARL is automatically liable to the customer for the proper performance of the obligations arising from the contract concluded at a distance, subject to legal grounds for exemption. No clause in these Terms may have the purpose or effect of removing or reducing the mandatory rights granted to the consumer.<\/p>\n<p>The seller&rsquo;s liability cannot be invoked in cases of misuse of the product, failure to follow storage recommendations, fault on the part of the customer, or force majeure within the meaning of French law, subject to applicable mandatory legal provisions.<\/p>\n\n<h2>13. Prohibition of Sale to Minors and Responsible Consumption<\/h2>\n<p>In accordance with French regulations, the sale of alcohol to minors under 18 is prohibited. By confirming their order, the customer confirms they are at least 18 years old on the date of the order.<\/p>\n<p>Faulkner Wine SARL reserves the right to request proof of age before accepting or shipping the order. Commercial messages and website content relating to alcoholic beverages must comply with the legal framework applicable to the advertising of alcoholic beverages.<\/p>\n<p><strong>Excessive alcohol consumption is harmful to health. Please drink responsibly.<\/strong><\/p>\n\n<h2>14. Personal Data<\/h2>\n<p>Personal data collected as part of orders is processed in accordance with applicable data protection regulations. Before the contract is concluded, the customer is informed of the essential information relating to this processing and may consult the website&rsquo;s Privacy Policy to learn about the purposes, legal bases, recipients, retention periods, and means of exercising their rights.<\/p>\n<p>The placement of cookies or trackers not strictly necessary for the operation of the website requires, where applicable, the user&rsquo;s prior consent, obtained under the conditions set out in applicable regulations.<\/p>\n\n<h2>15. Intellectual Property<\/h2>\n<p>All elements of the website, including text, visuals, logos, photographs, videos, graphic elements, and databases, are protected by applicable intellectual property rights. Any unauthorized reproduction or use is prohibited except as permitted by law.<\/p>\n\n<h2>17. Force Majeure<\/h2>\n<p>Faulkner Wine SARL cannot be held liable for a delay or failure to perform resulting from an event of force majeure as recognized under French law and case law. If the impediment continues beyond a reasonable period, either party may terminate the contract with respect to the unperformed part, without damages, subject to applicable mandatory rules.<\/p>\n\n<h2>18. Governing Law and Dispute Resolution<\/h2>\n<p>These Terms are governed by French law. In the event of a dispute, the customer is invited to contact Faulkner Wine SARL first to seek an amicable solution before referring the matter to the mediator or a court.<\/p>\n<p>The consumer customer may bring proceedings before one of the courts with territorial jurisdiction under the French Code of Civil Procedure, or before the court of the place where they resided at the time the contract was concluded or the harmful event occurred, under the conditions provided for by French law.<\/p>\n\n<h2>19. Updates to the Terms<\/h2>\n<p>Faulkner Wine SARL may update these Terms to reflect changes to the website, its offering, or applicable regulations.
